I'm really surprised by how straight up dumb so many people in that thread are. Instead of just saying things like "I have no moral problem with homebrew taking assets straight out of published games", many can't grasp the difference between copying character design from real life people and taking tiles and sprites from someone else's game and putting them in your own. Or how someone else doing something morally questionable doesn't give some other random person a free pass.
Most surprising of all, is how a guy could figure out how to program a game, but be the dumbest clown of all. Of all the crazy things he said (not a result of a language barrier), this last comment was still hard to believe:

I guess they don't know how seriously Nintendo takes their IP. They have shut down free fan games before that didn't even rip graphics, just used character names and themes. Directly stealing their work and using it for profit will land your ass in court in any first-world country Nintendo has presence in... which is to say, all of them.

They have no idea how ruthless Nintendo is. Let's use Youtube as an example. Usually the sample size is around 20 seconds before a 3rd party can claim copyright on your video. With Nintendo it is 5 seconds. I don't know how they negotiated that with Youtube. They don't care if your video gets 100,000 views or 1 view.

It's crazy to me that there are programmers ripping grafx from other games to make theirs when there are so many artists out there begging to be a part of projects, it seems like graphics should be a easily sourced element of any production at this point. I would've happily volunteered to make a metroidesque game and I am sure there are plenty of other artists out there who are better than me who would do the same. The fact he did this and then offered it for sale makes it feel like a cash grab to me.
I only skimmed a bit of the drama...but I saw enough to chuckle.
