So the legal software is not included, but the pirated game is.

Good thing he cleared that up.

I guess that maybe he didn't want eBay to think that he's trying to evade listing fees by providing the emulator outside of the auction.

Because that would violate their selling policy...

Don't bother reporting it, eBay won't do anything.

Its too bad that you can't post comments on an auction like you could on Yahoo auctions back in the day(I haven't check them out in years), because then someone could post a link to a site where potential buyers could download it for free.

Which is frowned upon by companies like Konami(remember the original Drac X mp3 project?), but its better than people outright selling them.
