No, NOT a trick, a Halloween treat! Presenting the Dead of the Brain 1 English patch by David Shadoff for the DEAD last official PC Engine CD game published by NEC before exiting the console biz in 1999! Without a distinct legal basis, however, if such actions are uncovered, the government can be taken to court, and the Supremes could nix their activities. Could also result in folks being booted from office. If they have a law saying they can do it, they don't have to hide it and can more easily compel cooperation from 3rd parties.
